Terms of Service

These terms govern your use of ClaimFast — the ClaimFast website, the ClaimFast web application, and the ClaimFast browser extension (together, the “Service”). ClaimFast is operated by Enmanuel Espinosa, a sole proprietorship based in Florida, United States (“ClaimFast”, “we”, “us”).
By creating an account or using the Service, you agree to these terms. If you do not agree, do not use the Service.
What ClaimFast does
ClaimFast fills the service-line rows of claim forms in billing portals you already have your own authorized access to. You tell ClaimFast your billing configuration — procedure codes, rates, units, and which days a patient attended — and it enters the corresponding rows into the claim form open in front of you.
What ClaimFast does not do
ClaimFast never submits a claim. It fills rows and stops. Every claim is reviewed and submitted by you.
ClaimFast also does not:
- log in to any portal on your behalf, or store your portal credentials;
- verify patient eligibility, coverage, or benefits;
- determine whether a service is billable, medically necessary, or correctly coded for a given patient;
- guarantee that any claim will be accepted, processed, or paid.
Your responsibilities
You remain fully responsible for every claim you submit. In particular, you are responsible for:
- Accuracy of what you configure. The rates, procedure codes, units, place of service, diagnosis codes, and provider identity you enter are yours. ClaimFast fills exactly what you saved; it cannot know whether those values are correct for your contracts.
- Reviewing before submitting. ClaimFast is a data-entry tool, not a reviewer. You must check every filled claim before you submit it.
- Authorization. You must have the right to access the portals and to bill for the services you are billing.
- Your account. Keeping your credentials secure and everything done under your account.
Patient information
ClaimFast is built so that patient and health information never reaches our servers. We do not receive, store, or transmit it. See the Privacy Policy for what is and is not stored.
ClaimFast is not a certified compliance product, and using it does not by itself make your billing practices compliant with any law or payer requirement.
Accounts
You need an account to use the Service. Provide accurate information and keep it current. You may close your account at any time from your account settings; doing so deletes your billing configuration.
We may suspend or close an account that violates these terms, or that is used to bill claims the account holder is not authorized to bill.
Fees
Paid plans are billed monthly in advance, per daycare configured on the account. Prices are shown before you subscribe. You can cancel at any time; your subscription then continues until the end of the period you have paid for, and is not renewed. Except where required by law, fees already paid are not refunded.
Where the Service is offered free of charge, we may change or end that arrangement with reasonable notice.
Acceptable use
Do not use the Service to submit claims you are not authorized to submit, to misrepresent services that were not provided, or in any way that violates payer rules or applicable law. Do not resell, sublicense, reverse-engineer, or attempt to extract the source of the Service.
Availability
We aim to keep the Service running but do not promise uninterrupted availability. Billing portals are operated by third parties and can change their forms or behavior without notice; when that happens, parts of the Service may stop working until updated.
Third-party portals and marks
The billing portals ClaimFast works with are operated by third parties and are governed by their own terms. Portal and payer names and logos are the property of their respective owners and are used only to identify the portals you bill through. ClaimFast is not affiliated with, endorsed by, or sponsored by any of them.
No warranty
The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free or that claims filled with it will be accepted or paid.
Limitation of liability
To the fullest extent permitted by law, ClaimFast will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, lost revenue, denied or delayed claims, penalties, or costs of recovery, arising out of or relating to your use of the Service.
Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve months before the event giving rise to the claim.
Indemnification
You agree to indemnify and hold ClaimFast harmless from claims, losses, and expenses arising from claims you submitted, from your billing configuration, or from your use of the Service in violation of these terms or applicable law.
Changes to these terms
We may update these terms. If a change is material, we will give notice by email or in the app before it takes effect. Continuing to use the Service after that means you accept the updated terms.
Governing law
These terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-law rules. The courts located in Florida will have exclusive jurisdiction over any dispute arising from these terms.
